Terms of Service

We value our customers and have written conditions that protects both our customers and us at Darkless!

By ordering anything from Darkless you're immediately bound to these Terms of Service. This document (“terms of service”) goes over everything we will and won't do but also sets the standards we have for our platform/customers.

CHANGES TO THESE TERMS

Darkless may review the Terms of Service periodically and reserves the right to change the Terms of Service at any time at its discretion by posting such changes on discord or on our site. Changes will be effective immediately when posted on discord or our site. Your continued use of the service following posting will constitute your acceptance of those changes. These terms of service will not apply to affiliates who are linked to Darkless in any sort of way.

ELIGIBILITY OF SERVICE

Darkless is defined as a professional service provider and can deny anyone access to our services. Defaultly people are made eligible to use our services when they're 13 years old and have parental permission. When someone (“client”, “customer”) isn't over the age of 13 or doesn't abide by the laws of the United States of America, we may take the non-exhaustive list of actions:

  1. Termination of your account.
  2. Termination of your service.
  3. Discontinued contact and support.
  4. Refusal of refunds.

IDENTIFICATION REQUIREMENTS

When purchasing a KVM/VPS from Darkless, you must provide either one of the following documents on request of our support team if your order is marked as fraud and we have reasonable suspicion to suspend your services for investigative purposes:

  1. Photo ID (e.g., government-issued ID card).
  2. Company ID (if applicable).
  3. Driver's License.
  4. Passport.
  5. Utility Bill (to verify address).
  6. Business Card (if applicable).

Failure to provide these documents may result in denial or delay of service.

RETURN POLICY

Darkless offers a 48-hour refund policy upon placing your order. To request a refund, you must provide a valid reason for the refund. Refund requests will be processed within 3 days, and the processing time will not be counted as days of used service. Please note that a transaction fee may be charged by the payment processing method. Once the refund is complete, you will not be able to purchase any products from us for 3 days to prevent potential abuse. No refunds will be granted if the request is made after the 48-hour refund period has passed, and does not apply to recurring invoices.

LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES

Darkless is not responsible for any loss of data that may occur. While we do perform regular offsite backups to protect your data, we recommend that you also make your own backups. It is your responsibility to ensure the protection of your data. Darkless will not be liable for protection or privacy of any content transmitted through any ISP, and/or services our users may use.

SERVICES PROVIDED BY DARKLESS ARE OFFERED ON AN "AS IS, AS AVAILABLE" BASIS. DARKLESS SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL DARKLESS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES, EVEN IF DARKLESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF DARKLESS'S SERVICE TO THE CUSTOMER IS INTERRUPTED OR MALFUNCTIONS FOR ANY REASON, DARKLESS SHALL NOT BE RESPONSIBLE FOR ANY INCOME LOSSES DUE TO DISRUPTION OF SERVICE DURING THE PERIOD OF MALFUNCTION OR INTERRUPTION.

LEGAL RIGHTS

Darkless reserves the right to refuse service to any individual or entity for any reason. For legal inquiries, please contact [email protected].

ACCEPTABLE USE POLICY

By using our services, you agree to comply with all laws and refrain from any illegal or abusive activities. This includes, but is not limited to, DDoS attacks, port scanning, crypto mining, bruteforcing, operating Tor exit nodes on our systems, and intentionally disrupting Darkless's network or harming our customers.

We reserve the right to suspend or terminate your service if we determine that your service is being used for any prohibited activities.

CHARGEBACKS

Any chargebacks or reversed transactions on your invoices will result in the immediate termination of your account and a ban on the use of our services.

CANCELLATIONS & SUSPENSIONS

If payment is not received within 48 hours of an invoice being issued, your service will be suspended. A 10% late fee may be applied after suspension. If payment is not received within 2 weeks of the invoice date, your files and service may be removed from our system.

YOUR DATA

Darkless is not responsible for the content stored on our systems by clients. If illegal material or stolen software is detected on our systems, we reserve the right to terminate the service without notice and without a refund.
